Privacy Notice

Introduction

This notice applies to all products and websites that we own and operate and all services we provide, including our training development tools, digital learning players, websites, mobile applications and underlying digital learning platforms, and any other apps or services we may offer. We refer to these simply as our ‘services’ for the purpose of this notice.

When we refer to ‘personal data’ we mean identifiable information specifically relating to you, such as your name, email address, mobile phone number, learning experience data, support queries and so on. If there is no way to identify you (for example, when your personal data has been aggregated and anonymized) then this privacy notice does not apply.

This privacy notice may be updated from time to time. Where a change is significant, we’ll make sure we let you know – either by a notification in one of the services you’re using or by sending you an email.

Who holds your data?

When we refer to ‘we’ (or ‘our’ or ‘us’), we mean Skilitics Limited, it’s parent holding company and all of its wholly owned subsidiaries. We are headquartered in New Zealand, have offices in the United States and operate globally.

We provide training development and delivery platforms, tools and services to corporate, education and healthcare providers. At the core of our platform is Interact, our adaptive learning development platform.

The principles we follow to protect your personal data

Our attitude to data protection is based on three core principles. They’re the basis of everything we do with your data.

Transparency: We recognize that data represents a valued human being and ensure that any processing of your personal data is communicated openly with honesty and transparency.

Security: We utilize and continually strive to stay up to date with best practice industry approaches to secure the data you have entrusted to us.

Authenticity: We accept that it is our responsibility to keep your personal data safe.

How we collect your data

When you use our services, visit our websites or use our learning solutions, we collect personal data. The methods we use to collect it are generally characterized into the following:

Information you provide to us directly:

When you use our services, we may ask you to provide personal data. An example is contact information you provide when registering to use our services, completing a form requesting contact, support or to obtain information. It may also include responding to emails, requesting a demonstration, participating in social aspects of our services, taking part in training, events or applying for a job. You can choose to withhold your personal information; however, this may mean you are unable to utilize some aspects of our services.

Information we collect automatically:

When you utilize our services we collect some information about you automatically such as your IP address, browser or device information. When using our learning solutions, we also collect information relating to your learning experience, such as the way you interact, the decisions you make and your learning results. This information is part of the underlying services we offer to assist our clients and users. We use it personalize and continually improve the services we provide to you. It provides insights into your approach to learning that allow us to enhance your learning experience, while assisting trainers, teachers and tutors to make improve their training strategy.

Some of the information we collect automatically utilizes tracking technologies which are similar to cookies.

Information we get from connected parties:

Nearly all of the information we collect comes directly from you. There are times we may obtain data about you from sources connected to you, such as your teachers, training administrators, or organisational support team. We use this information to validate the you are the correct recipient of our services, streamline your onboarding and configuration process, to enhance the systems which provide you support, and to improve and personalize your experience.

In any instance where we collect your personal data, we’ll only process it:

  • to meet our obligations to you, your employer or educator for the services we are providing, or
  • where we have legitimate reasons to process your personal data which do not contradict your rights, or
  • to adhere with a legal obligation, or
  • where we have your consent.

If we do not collect your personal data, we may be unable to provide our services to you, or some features within our services may be unavailable to you.

If you don’t have a direct relationship with us, but believe another party or organisation has provided your personal information to us for use with our services, you’ll need to contact that party or organisation with any questions you have about your personal data (this includes situations whereby you want to correct, amend, access or request the removal of your personal data).

How we use your data

The principal use of your personal data is to operate and provide you with the services you or somebody you have a relationship with (e.g. your employer or educator), has requested on your behalf, and to manage our relationship with you. Beyond this we may also use your personal data for purposes such as the following:

To communicate with you. This may include:

  • providing you information you have requested from us or information we’re required to pass to you (e.g. password resets, reports or additional services)
  • operational communications, such as changes to our services, assistance with using services, licencing or subscription changes, security changes and alerts
  • marketing communications in accordance with your communication preferences, and only related to the services you are using or another Skilitics service we think you could have an interest in
  • asking for your feedback or assistance in any research we’re conducting.

To support you: This could include working with you to resolve a technical support issue or any other issues relating to our services, whether by phone, email or in-service support. We may also utilize tracking to identify issues with our services with the aim of resolving the issues with minimum disruption to your user experience.

To improve our services and develop additional ones: For example, by monitoring your use of our services so we can continually improve them, or by conducting technical analysis of our services so we can optimize your experience and supply you with more effective tools.

To protect: To ensure we can detect and prevent any fraudulent or malicious activity which could compromise your personal data, and to ensure the fair use of our services by all users in accordance with our terms of use.

To analyse, aggregate and report: We may utilize your personal data to provide learning and training analytics, reports and metrics, which we collectively term as processed data. This processed data may be provided to parties which include:

  • you view reports, summaries or dashboards
  • parties connected to you who may have purchased the services on your behalf, and in accordance with our obligations under the service we have provided.

We may also use the personal data we collect about you and other users of our services (whether obtained directly or through parties connected to you) to produce aggregated and anonymized analytics and reports such as, group or industry learning statistics, topic insights and training efficacy.

How we can share your personal data

There could be circumstances which require us to share your personal data with third parties. In these circumstances, we will only disclose your personal data to:

  • other companies in the Skilitics group of companies
  • third parties who assist or enable us to use the personal data to, for example, support the delivery of or provide functionality as part of our services (e.g. technical support services)
  • law enforcement bodies, regulators, government agencies, courts or other third parties where we believe it’s necessary to comply with applicable laws or regulations, or to exercise, establish or defend our legal rights. When appropriate and possible, we will notify you of this type of disclosure
  • a potential or actual buyer (including its agents and advisors) in connection with a proposed or actual purchase, merger or acquisition of any aspect of our business
  • other parties where you have consented to your data being shared.

We may also share aggregated, completely anonymized data with other third parties.

International Data Transfers

When sharing data, it could be processed in, and be transferred to, countries outside the country you reside – such as to a country within the European Union, the United States. It’s possible these countries have different laws to those you’re accustomed. To put your mind at rest, if we disclose any personal data to a third party situated outside of the country you call home, we have safeguards in place to make sure your data stays protected.

For users in the European Economic Area (EEA), it means it’s possible that your data may be transferred outside of the EEA. If your personal data is transferred outside the EEA, it will only be transferred to countries that have been identified as providing adequate protection for EEA data (such as New Zealand), or to a third party where we have approved mechanisms in place to protect your personal data – i.e., by ensuring the party is Privacy Shield certified (for transfers to parties who are US-based), or by making sure the party has entered into the European Commission’s Standard Contractual Clauses.

Security

We’re committed to protecting and treating your personal data like we would a member of our own team. Ensuring we have the appropriate measures in place, both organisational and technical, to protect and secure your data is a priority.

Retention

How long we retain your personal data depends on our obligations to you under the service provided, and whether we have a business or legal requirement to retain it (e.g. to comply with any applicable tax, accounting or legal requirements).

We will retain your personal data for at least as long as we have a relationship with you and for a period of time afterwards if we have a business requirement to retain it, in accordance with our data retention practices and policies. When there is no further need to retain it, you can rest assured we’ll make sure it’s properly deleted or completely anonymized.

Your Rights

Personal data is your data and you have rights relating to it. These include:

  • knowing what personal data we have about you, and to ensure it is correct and up-to-date
  • requesting a copy of your personal data, or asking us to delete or restrict further processing of your personal data
  • objecting to our ongoing processing of your personal data

You can action your rights at any time by making a request directly to us.

We commit to being transparent and welcome your feedback on the way we handle your personal data. If you have questions or are unhappy in any way, please let us know by getting in touch. We will review your feedback, investigate any complaint, and try our best to get back to you within a reasonable time frame. You are also free to complain to your local data protection authority who can advise you on submitting a complaint.
